PAYMENTS:

​

Price quotation: 
Price quotes are good for thirty (30) days, after which time quotes are subject to review. 

​

Initial:​​

When making a booking, please note that a 50% retainer is due and is non-refundable. The remaining balance doesn't need to be paid until the cover is approved. The final files will only be sent once payment is done.

​

Failure to pay your deposit means your date is not secured and we may assign it to someone else.

​

All payments are invoiced via PayPal.

 

Final Payment:​

You must make final payments within 72 hours of approving the final cover file. Failing to meet the deadline incurs a £50 fee. If you give Designs By Charly prior notice of your delay, there won't be any additional charges.​

​

Rush Orders:​

Despite offering rush orders, Designs By Charly has the final say on whether they can accommodate them. Rush covers/branding/formatting etc. Rush orders are subject to additional charges. Rush orders are charged at £50 for within a week, and £100 for a rush order within a day.

 ​

Premades:​

Pre-made sales are final. Refunds or exchanges are not permitted once the invoice is paid. You must make payment within 24 hours of receiving the invoice. Failing to do that will result in it being placed back on the market. The completion of all final files for Designs By Charly may take 1 - 2 weeks.

Alterations:​​

Three significant alterations are offered by Designs By Charly during the design process. It involves changing images, themes, and increasing the size of elements. Changing the font, color, or title during the process is not seen as a revision.

​

Changes to images:​

If the main theme is modified after work begins, there will be a £50 charge per image change, regardless of the source of the image.

​

Work Flow:​

It is important to book your cover as soon as possible, preferably well ahead of any scheduled deadlines. Each additional modification will extend the completion time for Designs by Charly. Missed deadlines resulting from client changes and late bookings are not the responsibility of Designs By Charly.

When your appointment is confirmed, Designs By Charly will message you during you designated week. If you have any Pinterest/Mood boards, please email them. This is important to ensure both Designer and Client are connected to the projects vision. 

 

Designs By Charly operates on a first-come, first-served basis. 

​

Changes after approval:​

The Client acknowledges that only Designs by Charly has the authority to make changes to the cover. The Client agrees that they may be charged extra for any alterations made after approval or after the final files have been sent. Alterations to the final files will commence at £50 and could potentially go up depending on the number of files/changes. After the original final files are sent, this option will be available for just six months.

DESIGN SERVICES:​

Prices are subject to change at any time and without warning. Price is only guaranteed upon receipt of the retainer.

Each package comes with ONE distributor print file, for example KDP. Additional files, for ingram, B&N or 48H books or any other printer will be charged additionally.

 

Stock Images​

If the Client chooses to provide the cover image: They maintain the rights to just the image they provide. Details, such as flourishes, small extra images, and certain back images, are included in the cover design package and will not be the Client’s responsibility. The Client must obtain the correct rights and permissions for the use of the photo they are providing. Client agrees to indemnify and hold harmless Designs By Charly from any copyright and permission infringement action resulting from materials client provides.

 

AI USAGE:​

AI imagery is not used by Designs By Charly. Even though there are occasional mistakes and reputable websites neglect to appropriately tag AI, we are committed to being diligent in our efforts to prevent such errors. Should we mistakenly use an artificially generated image in our design, we will promptly correct it by removing it from the cover. Accidents are part of being human, but we are committed to making things right if they occur.

Designs By Charly's Photo:

​The image chosen will only be used for this project. Designs By Charly maintains full rights to this photo. Other authors/designers may have the same or similar images/models, and Designs By Charly can't be held liable for other covers that contain the same imagery.

​

Photo may NOT be sold, reused, or used out of context aside from the specified book-related printing, reproductions, and otherwise. It may be used for paperback and ebook promotion and online promotional use. It may not be used for resale items other than the eBook, and print book. If other sale items will be created from this photo, the Client will need to purchase the extended rights to the image.

​

Photo may not be used on any other printed work by alternate designers unless otherwise discussed. Designs By Charly maintains the rights to the specified photo.

​

Under any circumstances, Each image shall not be altered without Designs By Charly’s prior permission.

​

CANCELLATION:

​In the event of a cancellation, before work starts, no further expenses will be owed. The remaining balance will be owed if the work has begun on the project. Once work is booked, no refund will be given.

​

OWNERSHIP:

Designs By Charly maintains the full rights to all designs. Designs and their concept, including layout, image style, coloring, placement, and fonts, aren't permitted to be recreated or altered by another person.

​

The Client understands that no one except Designs By Charly should alter any image. The client also understands that additional charges apply for any alterations after approval and/or after sending final files.

Designs By Charly controls the rights to the cover to use as any self-promotion, portfolio, client viewing, etc.

​

If the client wishes to work with another designer on the completion of a book series, written permission must be obtained from the designer.

​

License:

​​The cost of cover design includes the standard license for the images and is limited to 500,000 units. Standard license does not cover merchandise items like mugs, stickers, magnets, etc. The client will need to pay the designer for an extended license if the book exceeds 500,000 print copies, or if the client would like to use the book cover design or book cover images on merchandise.

ATTRIBUTION

​Designs By Charly requires credit to appear in the Client’s book, whether on the cover or inside on the copyright page.

LIABILITY

​Designs By Charly isn't liable for damages of any kind, including loss of revenue, profits, business, reputation, or data, in any way related to our graphic design services. Designs By Charly isn't responsible for any claim, loss, or injury based on errors or inaccuracies on our site or our clients’ written documents once the cover has been approved.

Should Designs By Charly take longer to complete the project than originally indicated, i.e., due to a family emergency or act of nature, the Client will be contacted via email to agree upon a new project completion date. If a client seeks a different solution, we will discuss that.

​​

CODE OF FAIR PRACTICE

​Designs By Charly acknowledges that to the best of their knowledge, the work prepared is an original creation and has not been previously published, and/or consent to use has been obtained. The work prepared contains no scandalous, libelous, or unlawful matter. The Client and/or others may not use Designs By Charly products in any way that may infringe upon the rights of others.

 

Confidentiality

All client and designer’s personal information is considered confidential.

Defamation of Character 

The Client acknowledges that by placing any payment for package or service by the Designer they are agreeing to not post slanderous or hurtful comments on social media and/or third-party platforms that in any way may affect the Designer’s business. Any issues must be brought to Designs by Charly’s attention in order to resolve. Under The Defamation Act of 2013 any posts on social media and/or third party may be liable to legal action and may be fined under this civil law.

 

Changes to Terms of Service
You can review the most current version of the Terms of Service at any time at this page.
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

ACCEPTION OF TERMS

Both Designs By Charly and the Client will acknowledge acceptance of these terms. By acknowledging this contract, the Client agrees to hold Designs By Charly entirely free from any liability, including financial.
